Seriously? What's make you think it's abandoned? The artist's aren't dead, the product hasn't been released as freeware, seriously? The artist's are on an extended hiatus of indeterminate length, but they haven't said, "It's over! Do what you want with it!" I believe that you are standing on a slippery moral slope. If you were to make a copy of the Mall, with all of their shapes and styles, and even call it FLX (Fiddly-LinX (tm)) and somehow think that you are fooling anyone that you were making an original product, then I believe you would end up as an object of public mockery. By all means, make up whatever justification you like, but be prepared to accept the consequences for poor artistic and business choices. You are an artist with talent, I've seen your work here, why try and piggy-back onto someone else's operation which you yourself have repeatedly stated is dead? They're not expanding anymore, but they're not dead. Have the courage to make your own stuff your own way and have your own shop and your own forum and see what happens. I believe it'll only cost you $40 to start a One Book Shelf publisher's account ad then they peel off 33% from each sale. Small price to pay to find out if you truly have what it takes to be a successful model artist. Tell you what, I'll even loan you the $40 for startup. Seriously. -Eric |

Thus making his point -- some people will come down on one side, other people on the other. And it's the internet, so both sides will likely overstate their opinions, probably misread the other person's post, and be a little offensive. So, we're into the brave new future where everyone tried to figure out what they want from and for TLX and what they can put together. |

Hi guys, I'm not an attorney, but I just went through this process during the creation of my own terrain project. I sincerely doubt there is a patent on TLX. That said, anyone can make papercraft sets using that system. If I wanted to make a papercraft set that was constructed using the TLX system, I could. I think people are confusing the actual system with all the image assets. Those are totally separate things. There are four methods of IP protection: Copyright - this applies to all the actual artwork in the TLX sets. You CAN NOT use those. Trademark - this applies to the actual TLX name. You CAN NOT use that name. Trade Secrets - this is a little trickier, but it basically protects any future projects, or methodology that makes them market-competitive. This is the category for everything not covered by the other three methods of protection. Patent - this applies to the actual method of constructing a set. As in folding the paper to make the tabs, and cutting the slots out, and how everything fits together. This can be done with blank paper. It has nothing to do at all with the images, artwork, or what the set otherwise looks like. If there is no patent (and it is unlikely that there is), then you can use this method to make your own sets with your own artwork. This IS NOT the same as making a game using the Star Wars assets - those are covered under copyright, not patent. Actually describing the patent process is too involved for this post, but suffice to say that the above reasonings are pretty sound. Folding and gluing and cutting paper to construct various things has been around and the fairly novel usage of the TLX methodology is still not "non-obvious" enough to get a patent. I went through this trying to decide if my own terrain system was patentable, and I came to the same conclusion. Hence, anyone could make a copycat product, and I couldn't stop them. The fact that my product exists, and the fact that TLX exists, does however stop anyone else from applying for a patent. So the worst case scenario is just competition. That's probably why Denny kept this one so close to the vest. It was protected by trade secret until he chose to reveal it, as it was not patentable. So legally, if you guys want to make sets which work with TLX and use the TLX methodology, you can go right ahead. You just can't use the name or any existing artwork. |

I will add my name to the list (alongside Jaynz) of people who solicited more info on the business to determine the opportunity and suitability of a buyout. I also have not received a response. I sent it on 11/19/2013. It would be better to use what is here than start from scratch, but it is what it is. I think the ethical issue for me is not making TLX-compatible products but probably the planning and discussion on this board, which is owned by WWG. Filling the need gap / building a better mousetrap / etc. is a time-honored tradition as old as any business venture. If there is a need, people will fill it. Many will try, giving consumers options, some will survive, and fewer (hopefully some) will be truly successful. As has been said, we owe each other nothing; however, this has always been a wonderful community and it stinks seeing it slowly (or not so slowly) dissolve. |
